Terms and Conditions for Purchasing Gustron Products through the Rabbit Rewards Platform

Rabbit Rewards Company Limited (“Rabbit Rewards”) is the service provider for the Rabbit Rewards point accumulation program (“Program”) to Rabbit Rewards members (“Members”). It is also the provider of an electronic platform for selling goods and services to Members and/or interested purchasers, including operating as an exchange for buying and selling goods (E-Marketplace). Rabbit Rewards provides these services through the Rabbit Rewards application and website, as well as other Rabbit Rewards platforms (“Platform”).

This Platform is provided by Rabbit Rewards to Rabbit Bytes Company Limited (“Seller”) to enable the Seller to sell products, specifically the products specified by the Seller (“Gustron Products”), to Members.

In this regard, the Member or interested purchaser of Gustron Products acknowledges that when the Member or interested purchaser buys Gustron Products through the Platform, the Seller is deemed to have sold those products directly to the buying Member. Rabbit Rewards acts only as a platform service provider and is not the seller in any way. The duties and responsibilities between the Buyer and the Seller shall be as stipulated by the Seller in this version of the Terms and Conditions for Purchasing Gustron Products through the Rabbit Rewards Platform.


1. Conditions for Purchasing Gustron Products via the Platform and Member Benefits

(1) Members can purchase Gustron Products through the Platform at any time. A minimum of 1 item per 1 order must be purchased via the Rabbit Rewards application > Home page > Shopping Menu > Gustron logo > Select and purchase Gustron Products, or via the website https://rabbitrewards-gustron.myshopify.com/ or the website www.gustron.com. The Seller reserves the right to sell Gustron Products on this Platform only to Members who have successfully registered and logged in.

(2) Unless the order is canceled, a Member who purchases Gustron Products by completing a valid order (as per item 4.(1)) is entitled to receive 1 Point for every 20 Baht spent, credited to the ordering Member's account within 15 days from receiving the Gustron Products. (Rabbit Rewards reserves the right to calculate the spending amount strictly according to the conditions. Any fraction of spending less than 20 Baht will not be used to calculate accumulated points, according to item 1.(2) of this version of the Terms and Conditions for Purchasing Gustron Products through the Rabbit Rewards Platform).

2. Management of Gustron Product Order Information on the Platform

(1) All information related to the provision of the Platform service, as specified below, will collectively be referred to as "Order Information":

  • Buyer Information: e.g., Full name, shipping address, telephone number, email, member number, etc.

  • Order: e.g., Order number, order date, last modified date, place of order, product name, product type, product code, product brand, price, product, quantity of product purchased by the buyer and/or purchaser, product list (SKU), Barcode, product image, variable (color, size), order expiry date, product details, discount coupon code, discount value from coupon, number of discounted orders generated by the system, amount of additional discount provided by Rabbit Rewards and/or the Seller (as the case may be), additional memo by the buyer, additional memo by the seller (as the case may be), etc.

  • Proof of Payment: e.g., Transfer amount, transfer date, transfer time, transaction number, amount, fee, price, etc

  • Payment Channels: e.g., Debit card, Credit card, etc.

  • Gustron Product Shipping Information: e.g., Order number, personal information of the product buyer, latest delivery status, product value, etc.

(2) The Seller is responsible for managing the Gustron Product Order Information. In this regard, the Seller has the duty to manage, store, collect, use, process, and disclose Order Information to Rabbit Rewards, as the Platform service provider, including other personal information that may be obtained from using the Platform, for the following purposes:

  • (i) To process and verify orders received from the buyer through the Platform.

  • (ii) To confirm payment for Gustron Products made by the buyer to the Seller.

  • (iii) To use the Platform service, including improving and/or enhancing the efficiency of the Platform service provided by Rabbit Rewards.

  • (iv) To record transaction history, payment history, cancellation history of Gustron Product purchases, Gustron Product exchanges, and Gustron Product refunds, as well as other necessary information for payment service providers and/or payment receiving entities.

  • (v) To prepare a daily summary report of Platform transactions received from the buyer, including order information, payment information, buyer requests, transactions related to Gustron Product refunds, and other information necessary for the Seller to reconcile accounts.

  • (vi) To investigate transactions in cases where there is suspicion of inappropriate use of the service, non-compliance with the law, or violation of public order or good morals.

(3) All operations related to the personal information of the Seller and Rabbit Rewards must strictly comply with the provisions stipulated in the applicable personal data protection law and all related regulations, under the aforementioned purposes and/or within the scope specified in:

3. Conditions for Payment of Gustron Products on the Platform

(1) The Member purchasing Gustron Products on the Platform (“Buyer”) acknowledges that the Buyer must pay the price of the Gustron Products directly to the Seller and must make the payment in full through the payment channels specified by the Seller.

(2) For purchasing Gustron Products on the Platform, the Buyer agrees to choose one of the following payment channels: [SN4]

  • Credit Card: This method is available for all types of credit cards using Visa, Mastercard, or JCB. However, there may be restrictions on the buyer's online transactions, which are limitations imposed by the provider and/or the respective bank on the buyer.

  • Debit Card: This method is available for Thai debit cards using Visa or Mastercard. However, there may be restrictions on the buyer's online transactions, which are limitations imposed by the provider and/or the respective bank on the buyer.

  • PromptPay

  • Redeem Points for product or as a discount when purchasing products

(3) The Buyer, as a Platform user, accepts and agrees that the Buyer is responsible for the accuracy of the order information, payment information, and other details related to the Buyer concerning the Gustron Product purchase transaction on the Platform.

4. Shipping Conditions and Channels

(1) Once the Seller reviews the order received on the Platform and confirms that the Buyer has successfully paid for the Gustron Products and shipping costs through the specified channels (“Completed Order”), the Seller will proceed to ship the Gustron Products to the Buyer. The shipping duration may vary depending on the nature and quantity of the products in the order. The Buyer agrees to pay the shipping fee based on the product weight at the rate specified by the Seller as follows:

Notes

  • Shipping costs are calculated based on the product weight or the parcel box size, whichever rate is highest.

  • The Buyer can check the specified shipping costs on the payment page.

  • For large products, the Seller reserves the right to separate the packaging to 1 item per box and charge a separate shipping rate for each item.

(2) The Seller reserves the right to ship products to the Buyer only at the address specified by the Buyer in the order, which must be located in Thailand. The Seller also reserves the right to be exempted from liability in case of late delivery or failure to deliver due to reasons not caused by the Seller, such as no recipient at the specified delivery location or inability to contact the recipient.

(3) If the Buyer wishes to change or edit delivery information, such as full name, shipping address, or telephone number, after the order has been confirmed and/or paid for, this can only be done if the product has not yet been shipped. The Buyer can contact the Rabbit Rewards Customer Service Center via email at support@rabbit.co.th.

5. Conditions for Cancellation, Order Change, and Product Refund

The conditions for cancellation, product exchange, and product refund only cover purchases made through the website www.gustron.com. The Buyer must take action within 7 days from the date of receiving the product from the shipping company. The product must be in an unused condition. The Buyer has the right to proceed as follows:

(1) Adjustment of product items in the order: If the order has been confirmed and/or paid for, the Buyer can adjust the product items in the order, including quantity, size, color, scent, and other product details, only if the product has not yet been shipped. The Buyer can notify their intention to Rabbit Rewards at the Rabbit Rewards Customer Service Center via email support@rabbit.co.th by filling out the request form https://zfrmz.com/E6ZYpDgsEn4aoeILAG7e.

(2) Order Cancellation: The Buyer can only cancel the order if the product has not yet been shipped. The Buyer can notify their intention to the Seller through Rabbit Rewards at the Rabbit Rewards Customer Service Center via email support@rabbit.co.th. This must be done by filling out the request form https://zfrmz.com/E6ZYpDgsEn4aoeILAG7e and attaching proof of the order number, date of purchase, copy of national ID card, copy of bank book (for product refund), and any other additional details reasonably requested by the Seller for consideration.

(3) Product Exchange: The Buyer can notify the desired item and additional details regarding the condition of the product they wish to exchange by sending an email to support@rabbit.co.th. This must be done by filling out the request form https://zfrmz.com/E6ZYpDgsEn4aoeILAG7e and attaching clear proof that the Buyer received a defective product, such as a product that is unusable, expired, or if the Buyer received a product that does not match the order list (product type, color, scent, size).

The Seller reserves the right not to exchange products where the packaging or product box is dented, torn, wet, wrinkled, or damaged from the handling and shipping process if the product inside is undamaged (further details can be found in the product warranty conditions).

If the request is verified by the Seller, the Buyer can proceed to return only the defective items or items that do not match the order to the Seller at the following address:

The Seller reserves the right to exchange only for products that are defective or do not match the original order. The Seller will proceed to ship the new product within 7 working days from the date the Seller receives the defective product or the product that does not match the order back from the Buyer and the Seller has verified the product condition.

In the event that the Seller cannot exchange the defective product or the product that does not match the original order because the product is out of stock, the Seller will instead process a product refund to the Buyer.

(4) Buyer received an incomplete order: The Buyer can send additional details regarding the incomplete receipt of products to the email support@rabbit.co.th. This must be done by filling out the request form https://zfrmz.com/E6ZYpDgsEn4aoeILAG7e and attaching clear proof that the Buyer received an incomplete order, such as a video clip of unboxing the product. If the request is verified and approved by the Seller, the Seller will ship the missing item(s) to the Buyer at no additional shipping charge, within 7 working days.

(5) Product Refund:

A product refund will occur when the Buyer's request for cancellation of purchase has been reviewed and approved by the Seller.

· The product refund amount will be equal to the net value of the Gustron Product price received by the Seller from the Buyer (including the value after deducting discounts, if any), but excluding shipping costs

· The Buyer agrees to be responsible for all expenses related to product returns, including shipping costs, unless the return is due to the fault of the Seller.

Point redemption for products or as a discount when purchasing products

Refund of the points redeemed by the Member for products or as a discount when purchasing products back to the Member's account

15 working days from the date the request regarding the customer's and/or Buyer's product purchase cancellation is reviewed and approved by Rabbit Rewards and/or the Seller.

Use of promotion code for products or as a discount when purchasing products

Refund of a code with the equivalent value to the one the Member used to redeem for products or as a discount when purchasing products back to the Member's account

15 working days from the date the request regarding the customer's and/or Buyer's product purchase cancellation is reviewed and approved by Rabbit Rewards and/or the Seller.

Note: The Buyer can check the refund amount upon receiving an email confirmation from Rabbit Rewards or the Seller.

6. General Provisions

(1) The Seller reserves the sole right to change, add, or cancel any provisions in this version of the Terms and Conditions for Purchasing Gustron Products through the Rabbit Rewards Platform, including other related terms and conditions under the Program, at any time. The Buyer and Platform users have the duty to check these related terms and conditions under the Program on each occasion. The continued use of the Platform service by the Buyer and Platform users after any changes have been announced constitutes the Buyer's and Platform users' acceptance and agreement to such changes.

(2) If it is found that the Buyer used another person's credit card or credit card information to conduct a purchase transaction without the card owner's authorization or contrary to the card owner's intention, and the Seller receives a dispute from the card owner or the issuing bank that prevents the Seller from receiving payment for the products or being able to collect the money for the products from the card owner or the issuing bank, the Buyer shall be responsible for the product cost and all damages incurred. The Seller reserves the right to pursue legal action against the Buyer and/or relevant parties as prescribed by law.

(3) If any provision or part of the terms and conditions in this version is or becomes void, unlawful, or unenforceable for any reason under any law, that provision or part shall be deemed amended to the minimum extent necessary to make that provision or term valid, lawful, and enforceable. If it cannot be amended, the relevant provision or part shall be deemed severed, and such amendment or severance shall not affect the validity and enforceability of the remaining provisions or terms of this version of the terms and conditions.

(4) This version of the terms and conditions is governed by and shall be interpreted according to Thai law, and the Thai courts shall have jurisdiction over any disputes or claims arising out of or related to this version of the terms and conditions.
